Agamben is explicitly engaged with Foucault’s thesis on biopower in Homo Sacer, claiming that he aims to “correct or at least complete” it, though in fact he rejects a number of Foucault’s historico-philosophical commitments and claims. Suggesting that Foucault has failed to elucidate the points at which sovereign power and modern techniques of power coincide, Agamben rejects the thesis that the historical rise of biopower marked the threshold of modernity. Homo sacer is never subjected to ‘sanctioned forms of execution’ (Agamben 1998: 103) Thus, ‘ sacer ’, in the sense that Agamben wants to emphasise is ‘bare life’, is ‘ zoe -, in the Greek sense, the fact of being alive and nothing more, the fact of life exposed to death. Giorgio Agamben’s Homo Sacer: Sovereign Power and Bare Life, the first book of his multi-volume Homo Sacer project, urges a reconsideration of theories of sovereignty as put forward ‘from Hobbes to Rousseau’ (1998: 109). The theory of sovereign power offered by the book is based on the state of exception (as in Schmitt [1]) and the production of a bare, human life caught in the sovereign ban, which constitutes the threshold of the political community.
